Introduction:
Earlier in the year, a government-appointed Expert Committee examined the workings of the arbitration law in India and suggested reforms. Thereafter, last month, the government shared the draft Arbitration and Conciliation (Amendment) Bill, 2024 for public comments. The draft bill aims to boost institutional arbitration, reduce court intervention in arbitrations and ensure timely conclusion of arbitration proceedings. It proposes certain long-awaited amendments such as statutory recognition of emergency arbitration and rationalization of the definition of ‘Court’ within the Act.
